Rieff v. Evans

Public Justice and the Association of Trial Lawyers of America (now the American Association for Justice), filed an amici brief in support of plaintiff-appellee Mary Rieff, arguing that the right to jury trial was essential to the framers of the Constitution; that juries and judges usually come to the same decisions; that there is no need for a complexity exception to the right to jury trial because there are mechanisms in place to help juries understand difficult issues; and that allowing such an exception would lead to a slippery slope wherein no complex civil litigation would involve a jury.
