Holt v HHH Motors

Holt v HHH Motors

Car buyers who are misled about an inflated fee on paper work signed two contracts, one with an arbitration clause and a second contract without an arbitration clause.  Given the language of the documents, under normal rules of Florida contract law, the parties have not agreed to arbitrate.  In this appeal, the question is whether the Federal Arbitration Act overrides Florida law and requires the enforcement of the arbitration clause despite the lack of an agreement.
