Commissioner v. Banaitis and Commissioner v. Banks
In these consolidated cases, we joined a coalition of civil rights organizations in filing an amici brief urging the U.S. Supreme Court to reject the federal government’s attempt to require victims of discrimination to pay income tax on any attorneys’ fees they recover, even though they never receive the money and their attorneys already pay income taxes on that money. The brief was drafted by Douglas B. Huron and Stephen Z. Chertkof of Washington, D.C., with input from Public Justice’s Arthur Bryant and Victoria Ni.
