D.R. Horton

D.R. Horton

Public Justice and Public Citizen filed an amici brief urging the Fifth Circuit to enforce a decision of the National Labor Relations Board holding that, under the National Labor Relations Act, employers may not require their employees to sign arbitration agreements barring them from pursuing work-related grievances as a group. Our brief argues that the NLRB’s decision is consistent with federal arbitration law and does not run contrary to the U.S. Supreme Court’s decisions AT&T Mobility v. Concepcion and CompuCredit v. Greenwood.

The brief was written by Public Justice Staff Attorney Leslie Bailey, Senior Attorneys Paul Bland and Victoria Ni, and Brayton-Thornton Attorney Spencer Wilson, with assistance from Scott Nelson of Public Citizen.
