Fitzgerald v. Barnstable

Public Justice joined the American Civil Liberties Union (ACLU) and the National Women’s Law Center in an amici brief arguing for reversal of an appellate court’s dismissal of the plaintiff’s equal protection claim on the basis that it was precluded by Title IX, the federal law that prohibits sex discrimination at schools receiving federal funds. The United States Supreme Court struck a blow in favor of women’s rights, holding that a plaintiff who brings a Title IX claim to remedy sex discrimination is not precluded from bringing an equal protection claim under 42 U.S.C. § 1983 against a school district and its superintendent for unconstitutional sex discrimination.
