Foltz v. State Farm
On June 18, 2003, the U.S. Court of Appeals for the Ninth Circuit reversed a trial court ruling that permitted the blanket sealing of discovery materials and court records in a consumer fraud case against State Farm Insurance Company. We intervened in the case on behalf of several non-profit groups that monitor insurance fraud, urging the Court to rule as it did. We also succeeded in having the case file, which had been removed from the courthouse and erased from the court’s data based, restored to the public docket. Portland, Oregon’s Matthew Whitman and Kathryn Clarke, and Public Justice Attorney Leslie Brueckner were co-counsel.
