Kitimbo v. Baisden

Public Justice joined a lawsuit on behalf of Sarah Kitimbo, a former immigration detainee raped by a guard while held at the Elizabeth Detention Center in Elizabeth, N.J., a facility run by Corrections Corporation of America.

The lawsuit, filed in New Jersey state court, charged CCA with various forms of negligence, including failure to provide a safe detention facility; failure to properly screen, hire, train, and supervise employees; and vicarious liability for the rape and the attendant emotional distress. The suit further charged the guard with sexual assault, assault and battery, and negligent and intentional infliction of emotional distress.

The case has been settled.
