Amici to U.S. Supreme Court arguing that prisoners held as “enemy combatants” in Guantánamo Bay have a constitutional right to seek federal habeas corpus review of their indefinite detention.

Public Justice and the American Civil Liberties Union filed an amici brief, arguing that prisoners held as “enemy combatants” in Guantánamo Bay have a constitutional right to seek federal habeas corpus review of their indefinite detention. The brief urged the Court to carefully examine a number of factors and practical considerations to determine whether constitutional protections apply at Guantánamo Bay. The Court ruled in June 2008 that prisoners at the detention facility do have a right to a federal hearing.
