Public Justice and the American Civil Liberties Union filed an amici brief, arguing that prisoners held as “enemy combatants” in Guantánamo Bay have a constitutional right to seek federal habeas corpus review of their indefinite detention. The brief urged the Court to carefully examine a number of factors and practical considerations to determine whether constitutional protections apply at Guantánamo Bay. The Court ruled in June 2008 that prisoners at the detention facility do have a right to a federal hearing.
