Ellis v. Gallatin Steel Company
Public Justice filed a citizen’s suit under the Clean Air Act to stop Gallatin and Harsco from sending fugitive dust from their slag dumping operations across their property line and onto the property of neighboring residents. The suit triggered an EPA enforcement suit and consent decree that required containment of the dust, and also resulted in an $850,000 judgment for compensatory and punitive damages against Gallatin and Harsco on the residents’ private nuisance claim.
