Fletcher v. Brooke Group, Ltd.
We objected to a motion for preliminary approval of a no-opt-out settlement of present and future personal injury and economic claims against the Liggett cigarette company on the grounds that the proposed class was too sprawling to meet the certification criteria of Rule 12 and that Liggett failed to prove that its assets constitute a “limited fund.” Steve Baughman of Dallas was lead counsel with assistance from Public Justice Attorney Leslie Brueckner.
