We recognized more than a decade ago that the fundamental right of all people to go to court and seek remedy for injuries they had suffered was at grave risk. Despite our successes and those of our allies, Corporate America, led by the Chamber of Commerce, has battled back harder than ever.
This fall, Public Justice celebrates the 10-year anniversary of its Access to Justice Campaign. Originally created to challenge and defeat the assault on every citizen’s right to a day in court, it also educates the public and legal community about the challenges faced and helps develop the legal tools to defeat them nationwide.
Over the past decade, Public Justice has, with the support of our members, become the nation’s leader in the fight against mandatory arbitration, one of the biggest threats to access to justice in this country. Prior to the Supreme Court’s decision in Concepcion, we had also won landmark rulings preserving class actions in multiple states, and defeated proposed class action settlements that would have deprived class members of access to justice. In addition, Public Justice has argued multiple preemption cases throughout the country, in many cases defeating preemption in cases involving federal banking laws, unsafe transportation, drugs and medical devices. Recently, Public Justice has stepped up our campaign against abusive court secrecy, affirming the public’s right to learn about dangerous and defective products.
During the next 10 years, Public Justice’s Access to Justice Campaign will strive to be stronger and smarter and continue to push for fairness and basic protections for those who need it most!
